Employer Terms
These terms govern how employers post jobs and hire on JobClubb.com. Please read them in full.
1. About these terms
These terms govern how employers use JobClubb.com, run by Raaisha Technologies Private Limited, Kolkata ("JobClubb"), to recruit for the Airlines, Hospitality and Travel & Tourism sectors. By creating an employer account you appoint JobClubb as a recruitment consultant, on a non-exclusive basis unless agreed otherwise in writing, and agree to be bound by these terms.
2. Your account
Each property or office registers its own account with its own email address. You are responsible for the accuracy of your company details and for keeping your login credentials secure. Accounts may not be shared or transferred. You confirm that your company is duly constituted, that the person accepting these terms is authorised to do so, and that you are entitled to hire for the vacancies you post.
3. Job postings
Postings must describe genuine, current vacancies at your property, with accurate details of the role, qualifications and experience required, location, working hours, employment type and pay, or pay marked as not disclosed. JobClubb relies on these details when finding candidates. Postings must not discriminate unlawfully. We may edit or remove postings that break these terms.
4. How recruitment works
JobClubb screens the candidates who apply, holds a first-round interview at its office or online, and refers the candidates it shortlists to you. You see only the candidates JobClubb refers. You are responsible for any further interviews, tests, background checks and document verification, and you have complete discretion to select or reject any candidate. JobClubb does not guarantee that a suitable candidate will be found, and does not warrant any candidate's future performance or conduct.
5. Candidate information
For each referred candidate you see their name, skills, experience and resume. JobClubb coordinates your interviews with them, and handles communication with candidates about offers.
6. Selection and offer letters
As soon as you select a candidate, you issue the offer letter and upload it on JobClubb with its key terms, including the fixed monthly gross salary and joining date. JobClubb confirms the offer with the candidate and then delivers the offer letter to them on your behalf. You remain solely responsible for the contents and validity of the offer letter and for the employment terms.
7. Keeping JobClubb informed
You record on JobClubb, promptly, each candidate's selection or rejection, salary, designation, joining or failure to join, and later any resignation, termination or other end of their employment, with the effective date. JobClubb shares relevant information it has about candidates with you in the same way.
8. Fresher and Experienced Candidates
JobClubb shows on each candidate you select whether they are a Fresher Candidate, meaning they joined JobClubb through a JobClubb partner training institute, or an Experienced Candidate. There is no recruitment fee for a Fresher Candidate, unless you and JobClubb agree an administrative charge in writing. For each Experienced Candidate who joins you through JobClubb, you pay JobClubb a recruitment fee equal to one month's salary.
9. Recruitment fee
The recruitment fee is calculated on the fixed monthly gross salary stated in the offer letter and recorded on JobClubb, not on the candidate's previous salary. Where pay is structured as CTC, fixed and variable components or otherwise, the monthly figure is the one you and JobClubb agree in writing. GST is charged on top at the applicable rate. JobClubb may ask you for reasonable confirmation of the candidate's salary and joining date.
10. Invoices and payment
JobClubb invoices the recruitment fee after the Experienced Candidate joins. The invoice shows the candidate, position, joining date, monthly salary, fee, any agreed charges, GST and the total. Invoices are not paid on JobClubb.com: pay within 15 days of receiving the invoice by bank transfer (NEFT, RTGS or IMPS), UPI or another method JobClubb agrees, to the bank details on the invoice. Deduct tax at source only where the law requires it, and send JobClubb the certificate. If you dispute an invoice, tell JobClubb in writing promptly, with your reasons, and pay any undisputed amount on time. Late payment is a default, and JobClubb may suspend its services to you while undisputed invoices remain unpaid.
11. Replacement if a candidate resigns
If a candidate placed through JobClubb voluntarily resigns within three months of their joining date, as recorded in your employment records, JobClubb will refer one replacement candidate for the same or a substantially similar role, screened and interviewed in the usual way, with no further recruitment fee. You must notify JobClubb of the resignation promptly, with the date they resigned; a late notice does not extend the three-month period. You may interview and reject the replacement, but JobClubb's obligation is met by reasonable efforts to source and refer one, and not by an unlimited number of candidates. There is no replacement if you terminate or dismiss the candidate within three months, if their employment ends for any reason after three months, or for a replacement candidate who later resigns. The replacement is a limited facility, not a guarantee that a candidate will stay.
12. Offers through JobClubb
Every offer to a candidate you found on JobClubb is made through JobClubb. You agree not to send the offer to the candidate, contact the candidate about the role outside JobClubb, or otherwise bypass JobClubb to avoid a fee. A candidate introduced by JobClubb whom you employ is a JobClubb placement, even if further interviews or negotiations happened after the referral. If you hire a candidate introduced through JobClubb within 12 months of their referral without going through JobClubb, you owe JobClubb a fee equal to one month's fixed gross salary of that candidate, whether they are a Fresher or an Experienced Candidate.
13. Personal data
You may use candidate information only to assess and employ candidates for the role they were referred for, in line with the Digital Personal Data Protection Act, 2023, and must protect it with reasonable safeguards. You must not copy it out of JobClubb, share it with third parties or keep it longer than needed. JobClubb protects the information you give it in the same way, and each party keeps the other's confidential business information confidential.
14. Employment relationship
A candidate you appoint is your employee, not JobClubb's, and you remain responsible for all statutory and contractual employment obligations and for complying with employment law. JobClubb and you are independent contractors; nothing in these terms creates a partnership, joint venture, agency or employment between you.
15. Liability and indemnity
JobClubb is not liable for a candidate's misconduct, non-performance or resignation, for your decision to terminate a candidate, for employment or salary disputes, workplace incidents or statutory employment claims, or for business losses resulting from your employment decisions, except for liability that cannot lawfully be excluded. You indemnify JobClubb against claims arising from your employment relationship with a candidate, except to the extent caused by JobClubb's proven fraud or wilful misconduct. JobClubb indemnifies you against direct losses finally established to have resulted from its fraud or wilful misconduct.
16. Acceptable use
You agree not to submit false information, impersonate another organisation, scrape the platform, or use JobClubb for anything other than hiring for your own property. JobClubb's brand, website, database, forms and recruitment methods belong to JobClubb and may not be copied or commercially exploited without permission.
17. Ending these terms
Either you or JobClubb may end this arrangement with 30 days' written notice. Fees that have accrued remain payable, and a candidate JobClubb referred before the end who is appointed afterwards, as a result of that referral, still attracts the applicable fee. The sections on fees, confidentiality, data, liability and disputes continue to apply after the end.
18. Disputes
These terms are governed by the laws of India. Any dispute is first discussed between authorised representatives. If it is not resolved within 15 days, it is referred to arbitration by a sole arbitrator appointed by mutual agreement, or otherwise under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration is Kolkata, West Bengal, the language is English and the award is final and binding. Subject to that, the courts at Kolkata have jurisdiction, including for interim relief and enforcement.
19. Changes and contact
We may update these terms from time to time and will ask you to accept any material change. Notices may be sent by email to your account's address. Questions can be sent to support@jobclubb.com. By ticking the box below you confirm you have read this document in full.
